EMPLOYMENT STANDARD ACTS (ESA)

  • Sets out the minimum legal requirements for employers to follow when it comes to employment.
  • All employers must follow the minimum requirements that are set out for that province.
  • Ministry of Labour sets out the ESA for Ontario.
  • Note: ESA in a minimum standard.

THE HIGHLIGHTS

  • Minimum wage for office workers is currently $14 --> Increasing to $14.25 as of October 1st, 2020.
  • After 44 hours worked in a given week, an employee must be paid 1.5 (time and a half) times their regular rate or given time in lieu.
  • Employees are required to be paid for Public Holidays including New Years, Family Day, Good Friday, Victoria Day, Canada Day, Labour Day, Thanksgiving Day, Christmas Day, Boxing Day
  • If an employee is “terminated without cause”, the employers is required to pay out termination notice.
